As a key member of the broader legal team, you will balance the technical aspects of employment and industrial relations law. The role will look to understand the business imperatives behind workplace strategies and to structure advice in the context of these imperatives and limit any exposure to potential workplace disputes. Responsibilities advise on workforce change management, including the restructuring of workforces, notification and consultation obligations, redundancies, and redeployment; advise on senior executive matters (including executive service agreements, termination benefits (and related issues under the Corporations Act and ASX listing rules) and post-employment restraints); contribute to workplace training programs; manage a range of matters including in unfair dismissal proceedings and unlawful discrimination complaints, investigations, adverse action, discrimination, and breach of contract claims (including claims by or involving senior executives), post-employment restraint enforcement proceedings; advise on industrial matters, including enterprise bargaining and union disputes; advise on employment practices compliance and regulatory investigations by Fair Work Ombudsman and SafeWork authorities; liaise and manage a panel of external legal service providers; conduct training and risk management workshops to mine site managers in relation to their obligations under employment and safety law; manage of key workforce risks, including respect to accessorial liability, sexual and other forms of harassment, bullying, work health and safety (including on directors’ and officers’ due diligence obligations under WHS law), grievance management, whistle-blower matters, diversity, and social media in the workplace; assisting in the implementation of nationally standardised employment contracts, policies, and procedures; and advise on crisis management and incident response. Required Qualifications & Expertise tertiary qualification in Law with a current practicing certificate; minimum of five (5) – eight (8) years post-qualification experience in employment and workplace relations law preferably through a combination of private practice (top tier) and/or inhouse (blue chip) experience; specialist knowledge of relevant court and tribunal processes (Fair Work Commission, Federal Court, Federal Circuit Court, and Supreme Court); expert understanding of courts and tribunals to manage any disputes should they arise; comprehensive understanding of undertaking and executing transactions; experience and expertise in negotiating and drafting documentation; experience with advising executive committees and boards; superior written and verbal communication skills; and ability to influence at all levels of an organisation.
